Stop the scam: On the ‘digital arrest’ menace
The Supreme Court of India’s August 4 ruling concerning the "digital arrest" threat is significant because it avoids a false sense of security. Despite data from the Indian Cybercrime Coordination Centre indicating that grievances logged on the National Cyber Crime Reporting Portal dropped from 123,672 in 2024 to 58,249 in 2025, and reached 16,377 by mid-2026, the bench did not lower its guard. Acknowledging these statistics as "certainly encouraging," the Court instructed the Reserve Bank of India to distribute standardized guidelines for temporarily freezing mule accounts, urged state governments to establish cybercrime units and implement electronic Zero FIRs, and called for an inter-departmental panel to study compensation options for victims. Thanks to warnings issued by financial institutions, mobile network providers, and law enforcement, fewer elderly individuals and vulnerable citizens are falling prey to these fraudulent schemes, which previously capitalized on older generations' respect for official power and anxiety over legal threats. Nevertheless, fraudsters still manage to exploit young adults, working professionals, and seniors who have not seen these alerts. Furthermore, the exceptionally low number of legal convictions despite thorough investigations indicates that police forces must accelerate their efforts to combat these crimes.
Cybercriminals have demonstrated remarkable flexibility in their tactics. They utilize SIM boxes to disguise the true origin of their phone calls so they resemble domestic numbers, and they rapidly transfer stolen money through a web of mule accounts spread across various states. Additionally, these criminals now employ deepfake technology during video calls to deceive targets while staying hidden from detectives. Consequently, the swindlers constantly appear to remain one step ahead of the authorities. The Court's emphasis on returning stolen funds—successfully achieved in 36,290 instances totaling ₹18.05 crore—alongside the rapid resolution of account-freeze disputes and advanced detection tools like MuleHunter.AI deployed in over twenty banks, will assist in mitigating losses even when the culprits evade capture or trial. However, successful prosecutions remain uncommon because numerous extortion and scam operations operate out of foreign "scam compounds" located in Cambodia, Myanmar, and the broader Golden Triangle region. In Myanmar, these illegal hubs expanded due to overt and covert government backing; recent inspections led only to superficial raids, after which the facilities merely relocated to other regions within that war-torn nation. Following Beijing's severe crackdown in 2023 against operations targeting Chinese citizens, the perpetrators redirected their efforts internationally, even trafficking and abusing Indians to force them into defrauding people back home. To dismantle the infrastructure supporting these syndicates, New Delhi needs to leverage diplomatic channels alongside the United States, China, and ASEAN nations to pressure the governments in Naypyidaw and Phnom Penh into taking decisive action.
